This website is operated by The Enrichery. Throughout the site, the terms “we”, “us” and “our” refer to The Enrichery. The Enrichery offers this website, including all information, tools and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.

By visiting our site and/ or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms of Service apply  to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/ or contributors of content.

Please read these Terms of Service carefully before accessing or using our website. By accessing or using any part of the site, you agree to be bound by these Terms of Service. If you do not agree to all the terms and conditions of this agreement, then you may not access the website or use any services. If these Terms of Service are considered an offer, acceptance is expressly limited to these Terms of Service.

Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and services to you.

ONLINE STORE TERMS

By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority in your state or province of residence and you have given us your consent to allow any of your minor dependents to use this site.

You may not use our products for any illegal or unauthorized purpose nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws).

You must not transmit any worms or viruses or any code of a destructive nature.

A breach or violation of any of the Terms will result in an immediate termination of your Services.

GENERAL CONDITIONS

We reserve the right to refuse service to anyone for any reason at any time.

Credit card information is always encrypted during transfer over networks.

We reserve the right to limit the quantities of any products or services that we offer. ACCURACY OF BILLING AND ACCOUNT INFORMATION

We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e-mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors.

You agree to provide current, complete and accurate purchase and account information for all purchases made at our store. SEVERABILITY

In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.

TERMINATION

The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes.

These Terms of Service are effective unless and until terminated by either you or us. You may terminate these Terms of Service at any time by notifying us that you no longer wish to use our Services, or when you cease using our site.

If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these Terms of Service, we also may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to our Services (or any part thereof).

ENTIRE AGREEMENT

The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision.

These Terms of Service and any policies or operating rules posted by us on this site or in respect to The Service constitutes the entire agreement and understanding between you and us and govern your use of the Service, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms of Service).

Any ambiguities in the interpretation of these Terms of Service shall not be construed against the drafting party.

These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of 9111 Katy Freeway, Suite 310, Houston, TX, 77024, United States.

We reserve the right, at our sole discretion, to update, change or replace any part of these Terms of Service by posting updates and changes to our website. SERVICE AGREEMENT

GENERAL TERMS

SCHEDULING, CANCELLATIONS, & ATTENDANCE POLICIES

All scheduling is handled through each location’s Office Manager. You may call the office directly or send an email to the front desk to schedule, reschedule, or cancel a session. Sessions must be scheduled in advance and are subject to the coach availability.

Session fees are calculated according to the length of the session as reflected on our schedule. No adjustment to fees shall be made for time lost because of late arrival by the student or by early departure from session by the student. Extensions in session duration made in response to a late arrival or an early departure may be made at the discretion of the coach and will incur fees accordingly based on the standard hourly rate.

Any lost time due to the late arrival of the coach shall be compensated either by extending a session by mutual agreement or by deducting the lost time from fees for that session.

Clients may cancel or reschedule any session free of charge, as long as they notify the Office Manager in accordance with the following guidelines:

  • Cancellations or requests to reschedule sessions for any business day following another business day must be made no less than 24 hours in advance of the scheduled session’s start time.
  • Cancellations or requests to reschedule sessions for any business day following a non-business day must be made no later than 3pm the business day prior.
    • For The Enrichery’s summer operating hours, this means that any cancellations or requests to reschedule sessions on Monday must be made by 3pm the Friday prior.
    • For The Enrichery’s regular semesterly operating hours, this means that any cancellations or requests to reschedule sessions on Sunday must be made by 3pm the Friday prior.
 

If the client fails to give the office notice in accordance with the previous guidelines and subsequently cancels, no-shows, or shortens a session, the client will still be charged for the entire length of the session as scheduled. Additionally, clients who are at least 15 minutes late to their scheduled session can expect to be charged for the cancellation as a no-show if they fail to notify the office that they are running late but still planning to attend; our coaches are obligated to wait 15 minutes for their student to arrive but may leave our office after 15 minutes if we have not been notified that their student is running late for the session.

This policy also applies to “same-day reschedules” – i.e. sessions that are re-scheduled for another time, but on the same day. Should the client fail to reschedule the session with 24 hours notice – even for a different time on the same day as their original session – the original time slot will be treated as a late cancellation and the client will be charged for both sessions.

The above terms also apply to all sessions scheduled as part of a prepaid package or bundle. Failure to provide adequate notice of a cancellation or reschedule as outlined above will result in the client being billed the hourly rate for the session.

 

POLICY FOR REPEATED CANCELLATIONS

In order to ensure the best possible results for our students – and because effective habits are built through consistency – it is important that our clients commit to attending their regularly scheduled sessions. Clients who cancel sessions twice in a row will receive communication from their location’s Director to discuss scheduling options and assess whether a different day and time would better serve the student’s schedule.

After the third cancellation in one semester (regardless of whether or not cancellations are consecutive), clients will be contacted by their location’s Director in order to find a day and time that would be better for the client’s schedule & would allow for more consistent attendance.

 

SESSION INVOLVEMENT

We are committed to providing a productive learning environment for all students. In order to maintain an atmosphere that fosters optimal learning outcomes, we kindly request that parents and guardians refrain from sitting in on sessions. While we understand and encourage our parents to be genuinely interested and involved in their child’s education, it is our responsibility to create an environment that best promotes effective learning. 

Parents are welcome to attend the first 10 to 15 minutes of a student’s first session with The Enrichery or in the event of a first session with a new coach. Otherwise, please keep all questions, comments, and updates for the very end of a session. Should you anticipate the need for a longer conversation about your student and their progress, feel free to call or email your coach and/or location director to set up a time to talk.

 

STUDENT PORTALS

Location Directors and/or Academic Coaches may request access to student academic portals such as College Board, Common App (and other college application platforms), Canvas, and/or Skyward. These portals will be used exclusively during sessions and/or for the purpose of preparing for sessions to review and support student progress through mock exam (DSAT) scores, course and assignment grades, and/or the completion of college applications. 

Portal usage will also be in relation to the service the student is receiving and will exclusively be utilized or referenced through the span of services/sessions attended by the student.

 

VIDEO RECORDING NOTICE

For the safety and security of our students, please be aware that sessions conducted on our premises may be recorded under video surveillance. These recordings are never permanently stored and are handled with the utmost confidentiality. Recorded footage may be used to ensure the well-being of all participants as well as evaluate session quality and coach effectiveness by the Location Director and Trainer. By enrolling in our services, you consent to this recording practice. 

Unrelated to our security surveillance, parents are provided with a separate form within this registration packet for the purpose of opting out of photograph or video footage of their student being used in our marketing materials, including social media posts.

 

ADDITIONAL SERVICE-SPECIFIC TERMS

Some services provided by The Enrichery are subject to additional or adjusted terms and conditions based on the nature of the program or service. If that is the case, the additions and/or changes will be provided below.

 

INVOICING TERMS (for Hourly Sessions)

Coaching fees shall be calculated at the hourly rate of the agreed upon service and are subject to all cancellation and attendance policies. 

All clients are required to have a current credit card on file. The Enrichery will not accept payment via cash or check. However, we do accept payments via bank transfers or Zelle.

A courtesy invoice will be sent by the 17th and 3rd of each month via email. Clients are welcome to pay this invoice within 24 hours with any credit card of their choosing or via bank transfer or Zelle; however, The Enrichery will charge the card on file within 2-3 business days of sending the courtesy invoice. Payment is due in full at time of invoicing. A late payment fee of $35 per missed payment will be applied. 

Clients are responsible for maintaining a current credit card in The Enrichery system. In the event of a declined credit card or other failure to make payment, we will call to seek updated payment information. Should an invoice remain unpaid for two billing cycles, the client will be removed from the schedule and their session time will be made available to other students.

 

ACT & SAT TEST PREP-SPECIFIC TERMS

OUR COMMITMENT 

The Enrichery is dedicated to your child’s success. As such, we will always provide the following: 

  • Knowledge of standardized test content and strategies 
  • Clear explanations with reinforcement as needed 
  • Regular consultations to strategize, problem solve, and update you on progress 
  • Honest evaluations and statements of expectations 
  • Pleasant and professional interactions at every step of the way.

Sessions – particularly the first six – are mainly structured in an “I do – we do – you do” format. Later sessions are more centered around independent practice and feedback. See below for a general overview.

  • Coach teaches the strategies for the day. 
  • Coach & student practice strategies together (guided practice), with the coach providing feedback as needed.
  • The student practices independently in session (independent practice) and reviews the results with the coach. They will troubleshoot and provide feedback as necessary.

Students will be paired with coaches based upon student needs as shown by the diagnostic exam results and general personality fit. In some instances, this means students will have two coaches assisting in their preparation: one dedicated to the humanities sections and another dedicated to math. 

This program is designed to be 16 weeks with one two-hour session per week. Students will take a series of 4 mock exams to monitor progress and adjust their preparation as needed. All prep materials are included in session costs and will not be billed separately.

 

TEST SELECTION

Students are encouraged to take both a diagnostic ACT and a diagnostic DSAT with The Enrichery in order to make a decision on which test will be the best fit. Students who are actively enrolled – or students who subsequently enroll in the month following the diagnostic exam – will receive both diagnostics free of charge. Otherwise, the hourly rate for mock exams listed under the section “mock tests” will apply to both diagnostics. Students who already have official score reports from an ACT, DSAT (including exams provided for free at school), or PSAT can utilize those score reports while considering which test to prepare for in lieu of taking a diagnostic exam with us. 

We ask our students to commit wholeheartedly to their test preparation. As such, students may not switch between ACT and DSAT prep midway through the program, nor may they prepare for both exams simultaneously. Should a student wish to prepare for both tests, they will be expected to finish out one program before beginning the next. Students wishing to prepare for the alternate exam following their initial prep should complete the entire 16 week program to allow for the necessary timing and strategy practice.

Students wishing to continue preparing for the same test beyond the 16 sessions and/or add extra sessions to their Test Prep schedule are welcome to do so at the hourly rate of the respective service.

 

DIAGNOSTICS AND MOCK EXAMS 

The Enrichery’s test preparation program begins with a diagnostic exam to establish a baseline score. Since these exams are offered free of charge to students actively enrolled in test prep, clients have one month following a diagnostic exam to schedule test prep services without incurring the hourly fee of the respective service for the mock test.

Students will also take mock exams every four sessions to monitor progress. All mock exams will be scheduled by the office manager prior to the student’s first session. 

  • Mock exams occur on Sundays and begin precisely at 10:00 A.M.
    • Students are strongly encouraged to arrive no later than 9:45 A.M. Students arriving after 10 A.M. may miss the first section of their exam, as the proctor will not wait for all students to arrive before beginning the test.
      • No time will be added to the test section or to the exam as a whole as a result of a student arriving late.
      • Students arriving more than ten minutes late may be asked to reschedule. 
      • As is the case on the official exam, students will not be allowed to move on to the next section of the test until time is up for the current portion, regardless of whether or not they’ve finished.
 

These dates will be sent out to the parent, the student, and the coach via email to ensure that all participating parties are aware of testing ahead of time. If there is a scheduling conflict, please reach out to the office manager as soon as possible to work out a time that fits both the student’s test prep and personal schedule. 

Saturday and weekday mock exams are offered at select locations, and we are typically able to accommodate mock exams at our offices during school holidays, such as Presidents Day or Spring Break. Contact your office manager for more information.

 

YOUR COMMITMENT 

Your success is dependent upon your commitment to regular attendance, staying engaged during sessions, and thoughtfully completing homework outside of sessions. At-home practice is essential to your mastery of the material. We will achieve the best results when all parties — students, parents, and tutors — are fully committed to the process. 

Over the course of the program, homework will progress from “untimed” to “completed with a stopwatch” to “timed.” Students are responsible for completing all homework in between sessions. (See homework policy below.) That means: 

  • All homework must involve practicing the strategies – including timing – to reinforce the lesson.
  • On ALL homework students should write an asterisk * next to any question that they guessed on. Guesses do not indicate student knowledge and must be counted as a miss.
 

If a student does not complete their Test Prep homework, the below action plans will be enforced.

  • 1st Incomplete: The session will continue as scheduled; parents will be notified with a phone call. 
  • 2nd Incomplete: The student will be sent home from the session; parents are notified by phone and via email. The TP session is treated as a “late cancellation” and billed in accordance with our late cancellation policy.  
  • 3rd Incomplete: The student will be sent home and the session will be charged as a “late cancellation.” The student will be asked to restart Test Prep sessions at a later date when they have time to commit to completing their assigned Test Prep homework between sessions. No refunds for completed sessions or sessions canceled with less than 24 hours’ notice will be given in the event that a student is asked to leave the program.
 
 
OFFICIAL TESTING & ACCOMMODATIONS

While The Enrichery is happy to provide guidance where necessary, clients are ultimately responsible for registering their students to take an official test, as well as for seeking formal testing accommodations. Similarly, clients are also responsible for notifying The Enrichery of any formal, testing-board approved accommodations so that we may adapt sessions and mock exams accordingly in order to provide a realistic testing environment.

 

ATTENDANCE

Students will refrain from taking extended breaks in the process, barring pre-programmed school holidays and breaks. Sessions missed due to illness (either by the student or the coach) will be rescheduled immediately as often as necessary to stay on schedule. 

In the rare event that a student’s typical coach is unexpectedly unavailable, they may be rescheduled with a different team member in order to keep the program on track. Said team member will be fully briefed on student progress, performance, and recent mock tests to ensure a productive session. 

In the event that the student cannot commit to weekly sessions and/or regular mock exams, they will be asked to restart the program at a later date.

Sessions – particularly the first six – are mainly structured in an “I do – we do – you do” format. Later sessions are more centered around independent practice and feedback. See below for a general overview.

  • Coach teaches the strategies for the day. 
  • Coach & student practice strategies together (guided practice), with the coach providing feedback as needed.
  • The student practices independently in session (independent practice) and reviews the results with the coach. They will troubleshoot and provide feedback as necessary.
 

Students will be paired with coaches based upon student needs as shown by the diagnostic exam results and general personality fit. 

This program is designed to be 14 weeks with one session per week. Students will take a series of 4 mock exams to monitor progress and adjust their preparation as needed. All prep materials are included in session costs and will not be billed separately.

Students wishing to continue preparing for the same test beyond the 14 sessions and/or add extra sessions to their ISEE Test Prep schedule are welcome to do so at the hourly rate of the respective service.

 

DIAGNOSTICS AND MOCK EXAMS 

The Enrichery’s test preparation program begins with a diagnostic exam to establish a baseline score. Since these exams are offered free of charge to students actively enrolled in test prep, clients have one month following a diagnostic exam to schedule test prep services without incurring the hourly fee of the respective service for the mock test.

Students will also take mock exams every four sessions to monitor progress. All mock exams will be scheduled by the office manager prior to the student’s first session. 

  • Mock exams occur on Sundays and begin precisely at 10:00 A.M.
    • Students are strongly encouraged to arrive no later than 9:45 A.M. Students arriving after 10 A.M. may miss the first section of their exam, as the proctor will not wait for all students to arrive before beginning the test.
      • No time will be added to the test section or to the exam as a whole as a result of a student arriving late.
      • Students arriving more than ten minutes late may be asked to reschedule. 
      • As is the case on the official exam, students will not be allowed to move on to the next section of the test until time is up for the current portion, regardless of whether or not they’ve finished.
 

These dates will be sent out to the parent, the student, and the coach via email to ensure that all participating parties are aware of testing ahead of time. If there is a scheduling conflict, please reach out to the office manager as soon as possible to work out a time that fits both the student’s test prep and personal schedule. 

Saturday and weekday mock exams are offered at select locations, and we are typically able to accommodate mock exams at our offices during school holidays, such as Presidents Day or Spring Break. Contact your office manager for more information.

 

YOUR COMMITMENT 

Your success is dependent upon your commitment to regular attendance, staying engaged during sessions, and thoughtfully completing homework outside of sessions. At-home practice is essential to your mastery of the material. We will achieve the best results when all parties — students, parents, and tutors — are fully committed to the process. 

Over the course of the program, homework will progress from “untimed” to “completed with a stopwatch” to “timed.” Students are responsible for completing all homework in between sessions. (See homework policy below.) That means: 

  • All homework must involve practicing the strategies – including timing – to reinforce the lesson.
  • On ALL homework students should write an asterisk * next to any question that they guessed on. Guesses do not indicate student knowledge and must be counted as a miss.
 

If a student does not complete their Test Prep homework, the below action plans will be enforced.

  • 1st Incomplete: The session will continue as scheduled; parents will be notified with a phone call. 
  • 2nd Incomplete: The student will be sent home from the session; parents are notified by phone and via email. The TP session is treated as a “late cancellation” and billed in accordance with our late cancellation policy.  
  • 3rd Incomplete: The student will be sent home and the session will be charged as a “late cancellation.” The student will be asked to restart Test Prep sessions at a later date when they have time to commit to completing their assigned Test Prep homework between sessions. No refunds for completed sessions or sessions canceled with less than 24 hours’ notice will be given in the event that a student is asked to leave the program.
 
OFFICIAL TESTING & ACCOMMODATIONS

While The Enrichery is happy to provide guidance where necessary, clients are ultimately responsible for registering their students to take an official test, as well as for seeking formal testing accommodations. Similarly, clients are also responsible for notifying The Enrichery of any formal, testing-board approved accommodations so that we may adapt sessions and mock exams accordingly in order to provide a realistic testing environment. For ISEE exams, please let us know upon Test Prep registration if your student is taking the official ISEE at home (digitally) or at a testing center (on paper).

 

ATTENDANCE

Students will refrain from taking extended breaks in the process, barring pre-programmed school holidays and breaks. Sessions missed due to illness (either by the student or the coach) will be rescheduled immediately as often as necessary to stay on schedule.

In the rare event that a student’s typical coach is unexpectedly unavailable, they may be rescheduled with a different team member in order to keep the program on track. Said team member will be fully briefed on student progress, performance, and recent mock tests to ensure a productive session. 

In the event that the student cannot commit to weekly sessions and/or regular mock exams, they will be asked to restart the program at a later date.

PAYMENT & INVOICING

Payment in full is required to reserve a spot in the College Admissions Workshop. Clients who register before March 31 may split the fee in half. The first half will be due at time of registration; the second half will be due on or before May 1 of the same year. 

Clients registering for the workshop more than a year in advance are also eligible to split the payment in two. Please speak with your location director for more details. 

If a client is concerned about their ability to make a payment by the deadline, they should reach out to their location director immediately to discuss their options. Otherwise, failure to make a payment by the agreed-upon date may result in forfeiture of the student’s seat in the program.

 

REFUND POLICY

The client may request a full refund – minus a $350 deposit for credit card and processing fees – before any services are rendered. In order to request a refund, the client must provide 90 days written notice to their location director. After services are rendered, no refunds will be given.

 

LATE ARRIVAL AND CHANGE OF SCHEDULE  

No adjustment to fees shall be made for time lost because of late arrival by the student or by early departure from session by the student.

 

NO GUARANTEES  

The Enrichery makes no promises or guarantees with regards to a student’s college acceptance as a result of any consulting provided.

 

PACKAGES & BUNDLES

Services purchased as a package or in a bundle are subject to all general terms and conditions, as well as all service-specific terms and conditions outlined herein.

 

FEES PAYABLE TO THE ENRICHERY  

Fees shall be calculated at the rate of the agreed upon variation for the selected package. Unless otherwise determined with the Location Director and accounting team, payment is required in full at time of registration and must be received before any work can begin.

 

SCHEDULING, CANCELLATIONS, & ATTENDANCE POLICIES

Package & bundled sessions are subject to the same scheduling and attendance policies outlined in the general terms.

 

REFUNDS
